The Case That Threatens Labor Unions

Arguments in a case that threatens the ability of labor unions for public employees to organize, were heard before the Supreme Court this week.

For more than a half-century, the Supreme Court has upheld requirements that non-union workers pay a part of usual union dues assessed by a labor organization (which has a legal duty to represent them, too).  That began with private-sector workers, and was then extended to public employees, when union organizing is allowed in that sector.   But the extension of that approach to public workers is being challenged directly in a new case the Supreme Court has agreed to decide.

For public employee unions, the most important and enduring precedent in favor of shared financial responsibility for a union’s collective bargaining activity is the Court’s 1977 decision in Abood v. Detroit Board of Education.  A group of home-care providers in Illinois, who do not want to belong to a union or to pay dues, and do not want a union to speak for them, have asked the Court to overrule the Abood decision if it means they must yield in their opposition.

When a union is named as the bargaining agent for a group of workers, it is under a legal duty to represent all the workers, including those who refuse to join.  Under what is called the “agency shop” theory, all workers are not required to join the union, but they are required to pay through their dues a “fair share” of the union’s costs in representing them in bargaining over benefits and working conditions.

The Supreme Court has made clear, though, that the non-union members cannot be required to pay any part of a dues assessment that would cover the union’s political or ideological activity, to which those workers may (and often do) object.  Forcing them to do so, the Court has said, would violate their First Amendment rights.

During the arguments, the justices were divided along some unusual lines:

The mood of the Court’s more liberal members was one of obvious trepidation, and that of its more conservative members – except for Justice Scalia – was of apparent eagerness to reach anew the core constitutionality of compulsory union support among public workers. [..]

The hearing Tuesday had only gone for  couple of minutes when a lawyer for the National Right to Work Legal Foundation, William L. Messenger, was urging the Court to overrule Abood, and thus drawing heavy questioning from more liberal Justices, like Ruth Bader Ginsburg and Sonia Sotomayor, and, soon, Justice Elena Kagan.

What would turn out to be potentially decisive, though, was the Justice Scalia appeared determined to take away from Messenger his basic argument that public employee union activity is more about shaping public policy – with implications for the First Amendment – than about the traditional union role of seeking to improve the working conditions of those it represents. [..]

The home-care workers, their lawyer contended, were being coerced into financial support for a public employee union that wants to “petition the government” in their place, but in ways that some of those workers might well oppose.

That argument, though, would quickly gain the energetic support of Justice Anthony M. Kennedy, who repeatedly made an effort to push the whole argument up to the highest level of constitutional philosophy about protecting the diversity of views about what government policy should be.  [..]

The trend of the argument with Messenger at the lectern appeared to have alarmed Justice Kagan, who said that what was being discussed was “a radical restructuring of the way workplaces are run” throughout the country.  She noted the “passion and heat” now spreading across the country – as, for example – in Wisconsin, over the role of public employee unions.  She wondered if it was “fair” to suggest that Messenger was actually arguing that a “right-to-work law [that is, no compulsory union support) is constitutionally compelled.” [..]

The questioning – explicit and implicit – of the Abood precedent was interrupted from time to time by questions from Chief Justice John G. Roberts, Jr., who seemed to be focused primarily on whether or not this case involved who decides the pay scales of home-care workers – state officials or federal managers of the Medicaid program for the poor and disabled.  It was not clear where Roberts would be on the more basic question of public employee representation.

In his Washington Post opinion, Harold Meyerson sees the potential for the court to further align itself against the have-nots and the consequences for unions and workers:

If workers can benefit from contracts without paying even what it costs the unions to secure those contracts, those unions would suffer revenue declines that could render them toothless. Once their unions lost power, home-care givers – a group that is overwhelmingly female, disproportionately minority and almost universally poor – would be highly unlikely to get any more raises. Turnover rates within the care-provider workforce would surely rise.

Such a reconsideration could be of even greater consequence if Alito & Co. go further and rule that no member of a public-employee union should be required to pay the dues that go to securing his or her contract. With the decline of private-sector unions, ­public-employee unions have become the preeminent organizers of voter mobilization campaigns in working-class and minority communities, the leading advocates of immigration reform, the foremost lobby for raising the minimum wage and the all-around linchpin of the modern Democratic Party. A sweeping, party-line ruling by the five conservative justices in Harris could significantly damage the Democrats.

Whatever its effect on the nation’s partisan balance, a ruling that neuters the organizations that poor, working women have joined to win a few dollars an hour more would put a judicial seal of approval on the United States’ towering economic inequality. Well into the New Deal, the Supreme Court consistently overturned laws that enabled workers to win higher wages, helping to delay the advent of the middle-class majority that emerged after World War II. It now has the option to speed that middle class’s demise.

No one should be surprised these days when yet another company goes belly-up in these difficult financial times, especially in devastated economies such as Spain.  Yet the bankruptcy of Fagor, the flagship cooperative in the Mondragon Cooperative Corporation (MCC) has shaken many anti-capitalists around the world as akin to witnessing the ending of Camelot. The fact that at least two of the other largest cooperatives in the Mondragon network, Caja Laboral (the bank and financial center of the corporation) and Eroski (a chain of retail stores throughout Europe)  are in dire financial straits has only added to the ominous threat.

Fagor, with its 5,600 workers, is a relatively small part of the whole. Even so, Trevino (Fagor’s CEO) warns that its fall “will have an uncontrollable domino effect on the rest of the group with major social implications.” He believes Fagor’s liquidation would create a €480m hole at Mondragon, including inter-group loans and payments the group’s insurance arm would have to make on Fagor workers’ unemployment policies.

Mondragon has promised to find new jobs or offer early-retirement terms for as many as it can of Fagor’s Spanish workers, but this is a tall order in a country with 27% unemployment. Besides their jobs, workers stand to lose the money they had invested in the co-op if it is liquidated.

Demystifying the Mondragon Myth

For the last 50 some years, the growth of what is now the Mondragon Cooperative Corporation has given many anarchists, socialists and other progressives in the cooperative movement the hope that yes, Virginia, there really is a viable alternative to Capitalism or, at the very least, an economic system that could provide a transition to socialism. Moreover, although many socialists won’t easily admit it, there is often the underlying hope that somehow this transition could occur “peacefully”, without a real class struggle ending in state ownership; that somehow, within the belly of the beast of capitalism, the cooperative model could “out compete” the capitalist multinationals at their own game and become the dominant economic paradigm.

Yet, as one blogger commented in Alternatives to Capitalism,

“There is no escaping the need to challenge Wall Street and the other big financial centers across the world for political and economic power which requires a well-organized and intense class struggle […] something the promoters of these cooperative schemes try to evade as they try to convince workers there are ways around bringing mines, mills and factories under public ownership which is going to require the nationalization of entire industries.”

Jobs Stink

The number of jobs created in the month of December fell far short of the expected 200,000 and unemployment (U-3) fell to 6.7% the lowest it has been since November 2008. I think the word “disappointing” is an understatement:

Stock futures fell after the report was released.

The slowdown in hiring could cause the Federal Reserve to rethink its plans to slow its stimulus efforts. The Fed decided last month to cut back on its monthly bond purchases by $10 billion. It could delay further reductions until it sees evidence that December’s weak numbers were temporary.

Cold weather may have slowed hiring. Construction firms cut 16,000 jobs, the biggest drop in 20 months.

Still, December’s hiring is far below the average gain of 214,000 jobs a month in the preceding four months. But monthly gains averaged 182,000 last year, nearly matching the previous two years.

The proportion of people working or looking for work fell to 62.8 percent, matching a nearly 36-year low.

One reason for the big drop in unemployment in December was that many, many people dropped out of the labor force — 347,000, to be exact. They stopped looking for work, which made them no longer “unemployed” in the eyes of the Bureau of Labor Statistics.

Some of this is due to the fact that Baby Boomers retiring — but only some. Most of it has to do with the fact that the economy is still too weak to create enough jobs to draw people into the market. This is most clearly evident in the fact that younger people are leaving the labor force, too — or never even entering it — because they can’t find jobs.

Rob Portman of Ohio, who might have been the 2012 Republican vice-presidential nominee had the Romney people not been terrified that, if they put Romney and Portman on the same stage together, the earth would spin into a dark region of the galaxy made up only of the primeval tedium whence the cosmos came, and we’d all come out named Tagg or something. Now, though, he’s back in the Senate being “reasonable,” which means that Portman felt free to allow an extension of unemployment benefits to come to a vote in the Senate, so Portman then could devise a way to sabotage those benefits because that is reasonable and bipartisan and centrist, and nobody will yell at him on the radio too loudly back in Columbus or Elyria.

   It depends, he said, on whether lawmakers find a way to pay for the $6.4 billion cost. Wednesday, Portman said he has just such a way. He said that people drawing two other kinds of government aid — Social Security disability insurance payments (SSDI) and trade adjustment assistance (TAA) — can simultaneously get unemployment benefits, which he thinks is wrong.It depends, he said, on whether lawmakers find a way to pay for the $6.4 billion cost. The “compromise” on offer is to help the unemployed while stoking the usua; anger at a vague claque of disabled freeloaders elsewhere. Where ever did Portman get the idea that the country’s economy is beset by double-dipping cripples?

The Labor Department reported Friday that in December, the average unemployed person had been out of work for more than 37 weeks.

On July 23, 1913, 9,000 copper miners of the Keweenaw laid down their tools and walked off the job. The were led by the great Western Federation of Miners, and they had voted by a good majority for a strike: 9,000 out of 13,000 The main issue were hours, the miners wanted an eight hour day, wages, and safety. The miners hated the new one-man drill which they called the “widow-maker.” They claimed this drill made an already dangerous job more dangerous.

The mining companies had steadfastly refused to recognize the Western Federation of Miners in anyway. They would continue to refuse all efforts at negotiation or arbitration, even those plans for arbitration which did not include the union, and this despite the best efforts of Governor Ferris, and the U. S. Department of Labor. James MacNaughton, general manger of Calumet and Hecla Mining Company, famously stated that grass would grow in the streets and that he would teach the miners to eat potato parings before he would negotiate in any way with the striking miners.

The Keweenaw Peninsula was a cold, windy place, jutting out into Lake Superior from the Upper Peninsula of Michigan. This area was known as the Copper Country of Michigan and included Calumet Township of Houghton County, with the twin towns of Hancock and Houghton ten miles to the south. Calumet Township included the villages of Red Jacket and Laurium.

It was here in Red Jacket, on the third day of the strike that Annie Clemenc, miner’s daughter and miner’s wife took up a massive America flag and led an early morning parade of 400 striking miners and their families. Annie Clemenc was six feet tall, and some claimed she was taller than that by two inches. The flag she carried was so massive that it required a staff two inches thick and ten feet tall. The miners and their supporters marched out of the Italian Hall and through the streets of the Red Jacket to the Blue Jacket and Yellow Jacket mines. They marched silently, without a band, lined up three and four abreast. These early morning marches, with Annie and her flag in the lead, were to become a feature of the strike.

Fast-food workers are walking off the job in about 100 cities today in what organizers call their largest action to date. Today’s strikes and protests continue a campaign that began last year to call for a living wage of $15 an hour and the right to form a union without retaliation. Early this morning, Democracy Now!’s Amy Goodman and Hany Massoud headed to Times Square in New York City where a group of McDonald’s workers were joined by a crowd of hundreds of supporters to kick off their strike. We hear voices from the protest and speak to Camille Rivera of United NY, part of the newly formed New Day New York Coalition, which has organized this week of action to fight income inequality and build economic fairness.

Thousands of fast food and retail workers went on strike across the US on Thursday in a signal of the growing clamour for action on income equality.

In Chicago, hundreds of protesters gathered outside a McDonalds at 6.15am. As a large “Christmas Grinch” ambled about in freezing temperatures, demonstrators chanted for the minimum wage to be increased to $15 per hour.

It was the first of nine strikes in Chicago, with employees at McDonalds, Wendy’s, Walgreens, Macy’s and Sears also due to walk off shift. Low wage workers were due to strike across 100 cities through the day, including Boston, Detroit, New York City, Oakland, Los Angeles and St Louis.

The holiday season is upon us. Sadly, the big retailers are Scrooges when it comes to paying their staffs. Undergirding the sale prices is an army of workers earning the minimum wage or a fraction above it, living check to check on their meager pay and benefits. The dark secret that the retail giants like Wal-Mart don’t want you to know is that many of these workers subsist below the poverty line, and rely on programs like food stamps and Medicaid just to get by.  This holiday season, though, low-wage workers from Wal-Mart to fast-food restaurants are standing up and fighting back.

“Wal-Mart was put in an uncomfortable spotlight on what should be the happiest day of the year for the retailer,” Josh Eidelson told me, reporting on the coordinated Black Friday protests. “These were the largest protests we’ve seen against Wal-Mart … you had 1,500 stores involved; you had over a hundred people arrested.” Wal-Mart is the world’s largest retailer, with 2.2 million employees, 1.3 million of whom are in the U.S. It reported close to $120 billion in gross profit for 2012. Just six members of the Walton family, whose patriarch, Sam Walton, founded the retail giant, have amassed an estimated combined fortune of between $115 billion-$144 billion. These six individuals have more wealth than the combined financial assets of the poorest 40 percent of the U.S. population.

Raising the Minimum Wage Growing Momentum

The push for an increase in the minimum wage has grown with the recent passing of an increase in New Jersey from $7.25 to 8.25 with annual increases based in inflation. The amendment to the state’s constitution passed with 61% of the vote over newly reelected Governor Chris Christie’s objection. A Gallup poll conducted Nov. 5-6 shows that an even greater percentage of Americans would vote for an even higher minimum wage. According to a White House official, the Obama administration supports the bill introduced by Sen. Tom Harkin (D-IA) and and Rep. George Miller (D-CA) to raise the federal minimum wage from $7.25 an hour to $10.10 an hour in increments of 95 cents.

The same Gallup poll that showed 76% of Americans support for the increase, also showed support across party lines with 58% of self-identified Republicans supporting it. So what’s the problem? The issue is congress’ feral children, the Tea Party coalition in both houses who have vowed to block it and would completely abolish the minimum wage if they had their way. These are the same extremists who would repeal child labor laws, as well.

Despite the objections of the radical minority, the wave for an increase of the minimum wage is swelling as RJ Eskow observes:

There’s something happening here/what it is ain’t exactly clear …”

When Steve Stills wrote the dystopian anthem “For What It’s Worth” in 1966, it resonated with listeners who understood that great if half-hidden transformations were underway. There’s been a turn toward the dystopian in recent economic and social trends as well: Wall Street greed and criminality. The growing power of wealth over the political process. The rise of the Tea Party. The collapsing middle class. Growing inequalities of wealth. Lost social mobility.

But there were encouraging signs in 1966, as well as troubling ones, and that’s equally true today. Take the movement for a minimum wage. Voters in the state of New Jersey and the city of Tacoma, Washington voted to increase the minimum wage in last week’s election. These victories follow a series of polls which confirm that the general public holds strongly progressive views on issues which range from taxation to Medicare and Social Security.

Something is happening here.

As I walked toward the demo of the Fast Food Workers in Union Square, I heard the words and sounds of this song and couldn’t help but grin.  We were back!  The workers that is – not the “middle class,” not the “deserving poor”, not “the 99%.” As a working class kid from a union factory family, I got it.  Not only because you can’t really go around shouting “Middle Class of the World Unite” or “We are the Mighty Mighty Middle Class” – let’s face, it, it just doesn’t resonate – but because the very concept of “worker” which this movement seems to grasp intuitively changes the very nature of the struggle.  

“The Middle Class,” “the poor” and even “the 99%” define us in terms of how much wealth we have or do not have, regardless of how we got it, in the upwardly mobile mantra of Capitalism. As workers we are defined, instead, by what we do, how we appropriate the materials and provide the services necessary for the survival and comfort of the human species. And that is a pretty important difference.



Obama’s “middle class” framing of all that is good and important in society (and god know we all want a better lifestyle) is no more than the standard capitalist divide and conquer, the promise of individual upward mobility for the few at the expense of the many.  You too can be one of the chosen. And we often buy into it. We want to see ourselves as “better” because we have been able to buy our own home, or send our children to “private” or “charter” schools.  And we rationalize that it is because we deserve it – we’re smarter, more industrious, stronger, our skills are more necessary–not due to the whim of the time and place we were born into or that our skills and success are built on the back of the skills and hard work of others.

All of us have known an aunt who raised kids, worked outside the home all her life, carried on intelligent conversations about the world’s problems, worked for the community and has ended up relatively destitute.  What is her value? Is she poor because she deserved it?  How about many of our young people today who bought the American Dream, worked hard, even went to college if they could afford it and now, through the vagaries of capitalism are jobless or working in low paying jobs that will not allow them to get that middle class dream (unless they can still inherit it from their parents)?

The term “workers” reunites the labor movement by removing the distinction between the mostly white, working middle class (who usually got their middle class lifestyle through union benefits that their grandfathers fought for) and the less affluent workers who are often people of color, single mothers, immigrants, and increasingly young college educated workers who missed out on the brass ring due to the recent failing economy. As one worker put it:

“I don’t care if you’re blue collar, white, collar, pink collar or no collar — all of us have value.  Have you ever stopped to think how hard people work?  The people who cook for you, the bus driver who drives you to work in the morning?  The people who clean your house and your clothes?  Have you ever stopped to say ‘thank you’?  If you don’t know how to do that job, or if you don’t want to do that job, the best way to say thank you, no matter how much you make, is to stand in solidarity with us and RAISE THE MINIMUM wage!”

At Joe Hill’s funeral, sashes were worn by many in attendance with “WE NEVER FORGET” written on them in big bold capital letters. This slogan was also written on the program for the day’s events. A year later, the ashes were handed out to IWW delegates from every state of the USA (except Utah) and from countries all around the world. The envelopes also carried this slogan. The Labor Martyrs Project uses this slogan to honor all of our Labor Martyrs, quite certain that Fellow Worker Joe Hill would not mind.

Today we are fortunate to have a diary describing the current condition of domestic workers in Mexico. This is an issue which has received increasing attention in the last three years. A long-time activist in the Domestic Worker Movement, Irene Ortiz Rosen,  is the Co-Founder  and Director of Collectivo Atabal,  an organization of activists and  feminists formed to defend the rights, dignity and demands of domestic workers in Mexico City. She is also the Co-Author of “Así es, Pues” a socio-economic study of domestic workers in Cuernavaca. A recent emigrant from Mexico, she approaches the subject from a global perspective which emphasizes the class and anti-imperialist aspects of the struggle as well as its patriarchal nature.

In the world of labor, a large group of women whose work is the maintenance of the homes of others is largely ignored-domestic workers. According to the ILO, there are more than 52 million domestic workers in the world.

In almost all countries, domestic workers share the following characteristics:  1) invisibility; 2) migration; 3) low levels of education; 4) gender, ethnic and racial discrimination; and 5) the informality of their labor. These are all products of poverty.

Domestic workers make up an invisible workforce because their work is carried out in the private sphere, that is, the homes of their employers. Their contract is verbal, their work is isolated, and their mobility is common.

Generally they are migrants, usually, within their own countries. This is the case for indigenous women  and women who come from rural areas in Latin America.  And as the gap in inequality grows throughout the world, in the poorest countries the phenomenon of migration (usually without papers) is growing beyond borders.  That is how they arrive to United States and Canada, by informally working as House Cleaning Personnel, Nannies and Home Attendants. In New York alone, we are talking about more than 200 thousand people who are working under disadvantaged conditions due to their Undocumented status.



Their discrimination is shared with nearly all women, and its logic corresponds to the subordination of women in a patriarchal culture. Within the patriarchal view of the traditional role of women, their work is an extension of the reproductive role, which is considered natural for their gender.

We should not forget that women in general, as housewives and mothers, perform domestic work without any pay whatever. Consequently, their work is not considered part of the national economy despite the fact that it makes up about 20% of the GDP. If a woman looks for waged work, she enters the labor market in a disadvantaged way; forty-five percent of women domestic workers receive salaries that are 10% lower than salaries received by men for the same work.

Global economic policies that have impoverished the majority of the world´s population have brought women in all countries into  the public sphere. The women working in the public sphere then need to hire a domestic worker to care for their children and home. However, because they, themselves, are not paid well, they are unable to pay a fair  wage, even if they value the services being performed by domestic help.
