In Memoriam: Maya Angelou 1928 – 2014

Author, poet, singer, dancer, actress, but most of all, Civil Rights Activist, Maya Angelou died this morning at her home in Winston-Salem, N.C. She was 86 years young.

Rail Transport of Oil Safe. So Says the Oil Industry

With the debate over the Keystone XL Pipeline continuing, another important issue has arisen, transportation of crude oil by rail. Recent derailments and explosions have also brought into question safety considerations and the transport of Bakken crude, which is more dangerous to ship than other crude oil due to its flammability. This is not a new problem, in fact, it has been going on for decades and has been focused on the railroad tank car used, the DOT-111-A, as this McClathcy article reported in January:

Federal regulators might be weeks away from issuing new safety guidelines for tank cars carrying flammable liquids, after a series of frightening rail accidents over the past six months.

But the type of general-service tank car involved in recent incidents with crude oil trains in Quebec, Alabama and North Dakota – the DOT-111-A – has a poor safety record with hazardous cargoes that goes back decades, raising questions about why it took so long for the railroad industry and its federal regulators to address a problem they knew how to fix.

Other, more specialized types of tank cars received safety upgrades in the 1980s, and the industry’s own research shows they were effective at reducing the severity of accidents.

Tank car manufacturers have built new DOT-111A cars to a higher standard since 2011, but the improvements haven’t caught up to tens of thousands of older cars.

To be sure, improper railroad operations or defective track cause many accidents involving tank cars. But the National Transportation Safety Board, which makes recommendations but has no regulatory authority, has cited the DOT-111A’s deficiencies many times over the years for making accidents worse than they could have been.

In a segment on her show just last week, MSNBC’s Rachel Maddow illustrated the safety shortcomings of those rail tank cars used to transport this volatile crude oil, pointing to accidents, explosions, and toothless warnings going back over decades.

In April, the National Transportation and Safety Board (NTSB) has called on regulators to tighten standards and in early May, the Transportation Department issued a safety advisory pleading with companies that transport crude oil by train to discontinue old railcars

The advisory is non-binding, meaning it does not require companies to follow it, as an emergency order would. Yet it does apply to approximately 20,000 old tanker cars that companies rely on to carry Bakken crude from oil fields in North Dakota throughout the continent. The Transportation Department (DOT) recommended that only the sturdiest cars available are put to use, and that cars that cannot be destroyed should be updated.

Wednesday’s advisory came on the same day that the Transportation Department issued an emergency order forcing companies to provide communities alongside the rail routes with more information about the problems that are created when a spill or explosion takes place.  [..]

The DOT itself admitted crude shipments present “an imminent hazard” in an emergency order forcing companies to be more transparent with the areas they go through. Trains carrying oil generally include at least 100 cars. The emergency order requires all carloads with more than one million gallons of Bakken crude, equivalent to approximately 35 cars, to give local lawmakers notice that a train will be making its way through. Companies shipping oil by rail have never been forced to notify communities regarding hazardous material on board until this week.

An estimated 715,000 barrels of Bakken crude oil are shipped by rail every day.

It appears the oil industry is not going to lie down and take it.

American Petroleum Institute said it’s important to “separate fact from fiction” when it comes to shipping crude oil from North Dakota by rail.

The North Dakota Petroleum Council published a study Tuesday that shows crude oil taken from the Bakken reserve area in the state is similar to other grades of oil from North America. It does not, as the U.S. Department of Transportation suggests, pose a greater risk when transported by rail, the council said.

It is past time that the Department of Transportation stopped issuing toothless warnings and cracked down with inspections and heavy fines.

The SEC and Private Equity

Naked capitalism‘s Yves Smith appeared in RT news Boom/Bust to discuss the risky business and abuses of private equity in the real estate rental market. Her segment starts at 3:45.

PE Slump

Private-equity transactions overall have fallen 22 percent to $53 billion through April, data compiled by Bloomberg show, led by the drop in buyouts of public companies. The value of those leveraged buyouts declined to $3.2 billion compared with an average of $34 billion in the 10 years through 2013.

The peak for buyouts came before the financial crisis, when U.S. funds struck $659 billion of deals from 2005 through 2007, including the purchases of HCA Inc., Hilton Worldwide Inc. and Biomet Inc., the data show. Buying inexpensive public companies was generally easier for the funds than carve-outs are, said Raymond Lin, a mergers and acquisitions attorney at Latham & Watkins LLP.

“The easy days for private-equity buyers are over when they profited from buying undervalued companies,” he said. “Carve-out deals require a lot of up-front work that would incur additional costs and could affect returns.”

The Standard & Poor’s 500 Index, which reached a record this week, trades at 17.4 times reported profit, the highest level since 2010, according to data compiled by Bloomberg.

PE’s Limits

While high valuations haven’t scared off dealmaking between companies, buyout firms are motivated by different factors, said Gordon Caplan, chairman of the private-equity practice group at law firm Willkie Farr & Gallagher LLP.

“If business growth slows, companies have to buy things,” he said. “Private-equity buyers can’t create synergies like company mergers can in most cases.”

Corporations are more willing to spin off divisions as management continues to clean up underperforming businesses and pay down debt following the financial crisis, said Tom Franco, a partner at Clayton Dubilier.

SEC Official Describes Widespread Lawbreaking and Material Weakness in Controls in Private Equity Industry

At a private equity conference this week, Drew Bowden, a senior SEC official, told private equity fund managers and their investors in considerable detail about how the agency had found widespread stealing and other serious infractions in its audits of private equity firms.

In the years that I’ve been reading speeches from regulators, I’ve never seen anything remotely like Bowden’s talk. I’ve embedded it at the end of this post and strongly encourage you to read it in full.

Despite the at times disconcertingly polite tone, the SEC has now announced that more than 50 percent of private equity firms it has audited have engaged in serious infractions of securities laws. These abuses were detected thanks to to Dodd Frank. Private equity general partners had been unregulated until early 2012, when they were required to SEC regulation as investment advisers. [..]

Bowden pointed out that private equity is unique among the investment advisers the SEC supervises. The general partners’ control of portfolio companies gives them access to their cash flows, which the GPs can divert into their own pockets in numerous ways. Naked Capitalism readers may recognize that this arrangement is similar to the position mortgage servicers are in: they control the relationship with the funds source, and they are also responsible for records-keeping and remitting money to investors. And as we’ve chronicled at considerable length, servicers have shown remarkable creativity in lining their wallets and investors have been unable to discipline them. [..]

Needless to say, this overly cozy arrangement has proven to be a ripe breeding ground for illegal conduct.

It’s Melting Faster Than Predicted

The news about the climate is keeps getting worse. This week a report from NASA and scientists at the University of California revealed that some of the glaciers in West Antarctic “have passed the point of no return,” threatening greater sea level rise impacts than previously thought

The findings, which focus on the Amundsen Sea sector of West Antarctica, were published in the journal Geophysical Research Letters.

The glaciers’ grounding lines – the points at least one thousand feet below ice where they first lose contact with land – are moving further inland, and as that happens, the glaciers’ flow speeds accelerate. And the faster they flow, the more they thin- that means their days are likely numbered.

Only one of the six glaciers they studied, the Haynes Glacier, had an obstruction upstream to slow down these changes, but even its retreat is moving as quickly as the others, the scientists found.

Given these changes, glaciologist and lead author Eric Rignot, of UC Irvine and NASA’s Jet Propulsion Laboratory in Pasadena, California, stated, “The collapse of this sector of West Antarctica appears to be unstoppable.”

The effects of this meltdown is already being seen in cities like Miami, Florida

A new scientific report on global warming released this week, the National Climate Assessment, named Miami as one of the cities most vulnerable to severe damage as a result of rising sea levels. Alton Road, a commercial thoroughfare in the heart of stylish South Beach, is getting early ripples of sea level rise caused by global warming – even as Florida’s politicians, including two possible contenders for the presidency in 2016, are starkly at odds over what to do about it and whether the problem is even real.

The fact that the earth is warming even faster than expected and the cause is an increased level of carbon dioxide in the atmosphere and humans are adding to it with our reliance on fossil fuels, there are still those in seats of power who are denying that this is happening. Sen. Marco Rubio (R-FL), who is one of those possible presidential candidates, is one of them. Sen. Rubio, when was asked about climate change in an interview for ABC’s “This Week,” stated that he didn’t think there was anything that could be done to slow climate change that wouldn’t destroy the economy.

Rubio – who expressed deep skepticism about whether man-made activity has played a role in the Earth’s changing climate – told Karl he doesn’t believe there is action that could be taken right now that would have an impact on what’s occurring with our climate.

“I do not believe that human activity is causing these dramatic changes to our climate the way these scientists are portraying it … and I do not believe that the laws that they propose we pass will do anything about it, except it will destroy our economy,” he said.

Rubio said he didn’t know of an era when the climate was stable.

“The fact is that these events that we’re talking about are impacting us, because we built very expensive structures in Florida and other parts of the country near areas that are prone to hurricanes. We’ve had hurricanes in Florida forever. and the question is, what do we do about the fact that we have built expensive structures, real estate and population centers, near those vulnerable areas?” he asked. “I have no problem with taking mitigation activity.”

When asked by John Amato of Crooks and Liars what he thought of Sen. Rubio’s remarks, Rep. Alan Grayson (D-FL) said, “It’s insane, but that’s what passes for political discourse these days. It’s a complete rejection of facts, evidence and logic – the ‘Endarkenment‘.”

On HBO’s “Last Week Tonight,” host John Oliver pointed out just how out of touch with reality these denialists are.

What Sen Rubio and others with this attitude, don’t want to admit is that by 2060 if most of the eastern shore of Florida is under water there won’t be an economy there at all.

Pentagon Papers Charges Are Dismissed; Judge Byrne Frees Ellsberg and Russo, Assails ‘Improper Government Conduct’

New Trial Barred But Decision Does Not Solve Constitutional Issues in Case

Los Angeles, May 11 — Citing what he called “improper Government conduct shielded so long from public view,” the judge in the Pentagon papers trial dismissed today all charges against Dr. Daniel Ellsberg and Anthony J. Russo Jr.

And he made it clear in his ruling that the two men would not be tried again on charges of stealing and copying the Pentagon papers.

“The conduct of the Government has placed the case in such a posture that it precludes the fair, dispassionate resolution of these issues by a jury,” he said.

David R. Nissen, the chief prosecutor, said, “It appears that the posture is such that no appeal will be possible.”

Mother’s Day Turns 100: Its Surprisingly Dark History

As Mother’s Day turns 100 this year, it’s known mostly as a time for brunches, gifts, cards, and general outpourings of love and appreciation.

But the holiday has more somber roots: It was founded for mourning women to remember fallen soldiers and work for peace. And when the holiday went commercial, its greatest champion, Anna Jarvis, gave everything to fight it, dying penniless and broken in a sanitarium.

It all started in the 1850s, when West Virginia women’s organizer Ann Reeves Jarvis-Anna’s mother-held Mother’s Day work clubs to improve sanitary conditions and try to lower infant mortality by fighting disease and curbing milk contamination, according to historian Katharine Antolini of West Virginia Wesleyan College. The groups also tended wounded soldiers from both sides during the U.S. Civil War from 1861 to 1865.

In the postwar years Jarvis and other women organized Mother’s Friendship Day picnics and other events as pacifist strategies to unite former foes. Julia Ward Howe, for one-best known as the composer of “The Battle Hymn of the Republic”-issued a widely read “Mother’s Day Proclamation” in 1870, calling for women to take an active political role in promoting peace.

Around the same time, Jarvis had initiated a Mother’s Friendship Day for Union and Confederate loyalists across her state. But it was her daughter Anna who was most responsible for what we call Mother’s Day-and who would spend most of her later life fighting what it had become.

NYPD Shuts Down Muslim Spy Unit

As promised during his campaign for New York City Mayor, the New York City Police Department has disbanded the unit that was spying on the Muslim community. Announcing the shut down yesterday, Police Commissioner  William J. Bratton said that he wants to heal the rifts between the Police Department and minority communities that have felt alienated as a result of policies pursued during the Bloomberg administration.

“The Demographics Unit created psychological warfare in our community,” said Linda Sarsour, of the Arab American Association of New York. “Those documents, they showed where we live. That’s the cafe where I eat. That’s where I pray. That’s where I buy my groceries. They were able to see their entire lives on those maps. And it completely messed with the psyche of the community.”

Ms. Sarsour was one of several advocates who met last Wednesday with Mr. Bratton and some of his senior staff members at Police Headquarters. She and others in attendance said the department’s new intelligence chief, John Miller, told them that the police did not need to work covertly to find out where Muslims gather and indicated the department was shutting the unit down.

The Demographics Unit, which was renamed the Zone Assessment Unit in recent years, has been largely inactive since Mr. Bratton took over in January, the department’s chief spokesman, Stephen Davis, said. The unit’s detectives were recently reassigned, he said. [..]

Based on Mr. Davis’s remarks, the Police Department appears to be moving its policies closer to those of the F.B.I. Both agencies are allowed to use census data, public information and government data to create detailed maps of ethnic communities.

The F.B.I. is prohibited, however, from eavesdropping on and documenting innocuous conversations that would be protected by the First Amendment. F.B.I. lawyers in New York determined years ago that agents could not receive documents from the Demographics Unit without violating federal rules.

The units records, however, must be preserved due to lawsuits that have been brought against the department and the city in federal court. Last January, U.S. District Judge Charles Haight, Jr. documents turned over for discovery. City officials have admitted last year that the unit never produced any terrorism leads.

Mayor de Blasio said in a statement Tuesday that the closing of the unit was “a critical step forward in easing tensions between the police and the communities they serve, so that our cops and our citizens can help one another go after the real bad guys.”

This a major step in that healing process but doubts still remain. Ms. Sarsour and New York Times reporter, Matt Apuzzo, discussed the unit’s shut down with Democracy Now‘s Amy Goodman.
