On Up with Chris Hayes, Chris and his guests exam the drone war and President Barack Obama’s ‘kill list’ that was revealed in a much read and discussed article in the New York Times. In the following three segments Chris along with Colonel Jack Jacobs, MSNBC military analyst; Hina Shamsi from the ACLU’s National Security Project; Jeremy Scahill of The Nation magazine; and Josh Treviño of the Texas Public Policy Foundation, discuss new revelations about the Obama administration’s drone program, including a reported “kill list” overseen directly by President Obama. They also examine the possibility that the Obama administration has been classifying civilian casualties as combatant deaths, as well as, the Obama administration’s contention that its targeted killing program is constitutional, and asks whether Congress is failing to hold the president accountable.

During the Bush administration the Democrats were opposed to the unitary executive powers that Bush assumed. When they realized how intrusive the government had becomes post 9/11 with surveillance, warrantless eavesdropping on American citizens, torture, indefinite detention, military commissions, Guantanamo and the general disregard for the rule of law, the Democrats railed against those policies. What happened that all these polices and now, targeted assassinations without due process have become acceptable? It is incomprehensible that under a Democratic president the right wing shredding of the Constitution is reasonable and defended by those who most vociferously opposed it.

In a New York Times Editorial, Andrew Rosenthal wrote this about President Obama’s “Kill Lists” and the use of unmanned drones:

Apologists for the president’s “just trust me” approach to targeted killings emphasize that the program is highly successful and claim that the drone strikes are extraordinarily precise. John Brennan, the president’s counter-terrorism adviser, said in a recent speech that not a single non-combatant had been killed in a year of drone strikes in Afghanistan and Pakistan. And today’s Times article quoted a senior administration official who said that civilian deaths were in the “single digits.”

But it turns out that even this hey-it’s-better-than-carpet-bombing justification is rather flimsy. The Times article says “Mr. Obama embraced a disputed method for counting civilian casualties …It in effect counts all military-age males in a strike zone as combatants, according to several administration officials, unless there is explicit intelligence posthumously proving them innocent.”

The logic, such as it is, is that people who hang around places where Qaeda operatives hang around must be up to no good. That’s the sort of approach that led to the false imprisonment of thousands of Iraqis, including the ones tortured at Abu Ghraib. Mr. Obama used to denounce that kind of thinking.

So now just living in a village where the US thinks, there are insurgents, be they really Al Qaeda or just people defending their country from invaders, all men in the vicinity are enemy combatants, the President can have you killed and they can prove their innocence post mortem. As Cenk Uygur stated, “This is deeply immoral”

“Memorial Day weekend brought news of more U.S. drone attacks in Pakistan and Afghanistan as The New York Times raises new questions about President Obama’s so-called “Kill List” of terrorists targeted for assassination. An extensive report in Tuesday’s paper looks at the use of targeted attacks to take out terrorism suspects in other parts of the world, an increasingly important part of the government’s anti-terrorism policies that Barack Obama himself has taken personal responsibility for. According to the story, the President approves every name on the list of terrorism targets, reviewing their biographies and the evidence against them, and then authorizing “lethal action without hand-wringing.”

As the president has slowly drawn down American forces in Afghanistan and Iraq, the use of drone attacks to take out senior leaders of al-Qaeda

and the Taliban has become the primary tactic for fighting terrorism overseas. However, it raises a lot of legal and ethical questions about extra-judicial killings of individuals, particularly those who happen to be American citizens…”.

{T]oday the harm that’s caused by raining death from machines in the sky down onto far too many civilians — including someone’s son, brother, or father who wasn’t “up to no good” at all — vastly outweighs any good. Righteous anger over the killing of civilians creates new terrorists faster than the killing of any old ones. As for the morally indefensible position that any male killed in such an attack is “probably up to no good,” isn’t the Obama administration saying the EXACT same thing that George Zimmerman said about Trayvon Martin? [..]

Actually, the similarity with Zimmerman is even greater than I first thought. What he said to the Sanford police dispatcher was that Trayvon Martin “looks like he’s up to no good.” Thank God Zimmerman didn’t have drones, huh?

Some of us on the left, many of whom supported President Obama in 2008, have some very serious issues with this President and those of his supporters who are choosing now to ignore all the horrendous violations of US and International law and the continued trampling of our rights and freedoms, but are now wholeheartedly accepting and defending these policies (Warning: link leads to a right wing Obama 527). They would love it if Obama’s critics would just sit down and shut up.

What has happened to Democrats who were willing to call for not just the impeachment but the arrest and prosecution of both George W. Bush and Dick Cheney? Now Barack Obama has taken those same policies a step further and made them acceptable to his loyal supporters but not to those of us who still hold to the same principles we did eleven years ago.

Meet the new “Death Sentence Czar” appointed by President Barack Obama to choose who will be targeted for assassination by unmanned drone without due process

WASHINGTON-White House counter-terror chief John Brennan has seized the lead in choosing which terrorists will be targeted for drone attacks or raids, establishing a new procedure for both military and CIA targets.

The effort concentrates power over the use of lethal U.S. force outside war zones within one small team at the White House.

The process, which is about a month old, means Brennan’s staff consults with the State Department and other agencies as to who should go on the target list, making the Pentagon’s role less relevant, according to two current and three former U.S. officials aware of the evolution in how the government goes after terrorists.

John Brennan,a top CIA aide to George Tenet during the Bush Administration, was President Obama’s choice for CIA Director. He voluntarily withdrew his name because of the controversy over his support of the Bush policies of the torture of terrorist detainees and the governments extraordinary rendition program. Instead the president appointed Brennan as his counter-terrorism chief and now has put him in charge of killing accused terrorists around the world.

Glenn Greenwald reports that Brennan has been caught lying on a number of occasions about the circumstances surrounding some high profile cases.

{..}including falsely telling the world that Osama bin Laden “engaged in a firefight” with U.S. forces entering his house and “used his wife as a human shield,” and then outright lying when he claimed about the prior year of drone attacks in Pakistan: “there hasn’t been a single collateral death.” Given his history, it is unsurprising that Brennan has been at the heart of many of the administration’s most radical acts, including claiming the power to target American citizens for assassination-by-CIA without due process and the more general policy of secretly targeting people for death by drone.

Brennan will be the sole arbiter of who to recommend to President Obama to target for assassination. No evidence presented in court, no judge, no jury, no chance for the victim to defend himself and in total secrecy It has now become extremely easy to have someone killed, all this under the guise of “Change” with the blessing of the winner of the Nobel Peace Prize.

What is even more disconcerting is the loyalists to this President who defend or conveniently ignore all of the things they decried just a short 4 years ago: Torture, the Patriot Act, warrant-less eavesdropping, rendition, Guantanamo, indefinite detention. All of this is now acceptable under this president. Dick Cheney must be so proud.

Under cover of the night around twelve police cars stopped five journalists when they were heading back to where they are staying in Chicago during the NATO summit. All five have been covering protests against the NATO summit for the past few days.

The five journalists included Luke Rudkowksi, who streams as @Lukewearechange, Tim Pool, who streams as @Timcast, Jeoff Shively (@Jiraffa), Dustin & Jess. They are known for their work livestreaming and tweeting out regular coverage of Occupy protests.

There appears to have been a conscious targeting of bloggers and livestreamers. The Chicago police, possibly with help from the Department of Homeland Security, FBI or other federal agencies, appear to be working off a list of “suspected” people or spaces where they must go “check in” on what is happening simply to ensure all is safe. Of course, this is illegal. Without a warrant or probable cause, rights are being clearly violated.

In each of these instances, the police did not inform those detained why they were being detained. The police stopped them to find criminal activity that they could then use against the journalists to make arrests. And so far they have not been able to find any justification for arresting any of these people, but they have been able to briefly frighten and infuriate these journalists and also to impound a vehicle.

Vice President Joe Biden started a storm over marriage equality when he announced on Meet the Press that same sex marriage was OK with him. The press immediately wanted to know if President Obama’s position had “evolved.” The Biden interview was taped on Friday, so the White House was fully aware of what he had said. Finally, after three days of media over kill, the passage of Amendment 1 in North Carolina and the drying up of donations from the LGBT community, Pres. Obama announced that he “personally” supported same sex marriage. But hold your horses, people, this was just his personal opinion, not his political policy. Obama is still refusing to issue an executive order that would ban discrimination of gays, lesbians and transgender workers by federal contractors. From Sam Stein at Huffington Post:

The senior administration officials declined to say whether the president would now push for gay marriage to be part of the Democratic Party’s platform at the convention. They also said they were not changing positions on an Executive Order that would ban discrimination on the basis of sexual orientation against federal contractors. The president has said he would not sign that order. [..]

There were, however, reasons why even party officials were insisting, not all that long ago, that the president needed to put this off until after the election. There is concern that support for gay marriage will drive away voters in some conservative-leaning swing states. There is even more concern that Republican operatives can and will use the issue to go after the president.

Letting each state decide on the equality of individuals is not the best idea either. How would individuals have voted in states like Mississippi if they had been given the choice about civil rights? Marriage equality is a federal matter since states are required under the Constitution to recognize marriage contracts from other states. Therefore, they should not be permitted to restrict marriage to heterosexual couples.

Does anyone at this point seriously believe that any of the people who voted for NC’S Amendment 1 will ever vote for Obama, no matter what his stand is on marriage equality? Only time will tell if the campaign donation faucet suddenly opens since it had dried up because of the work place discrimination issue. While it is certainly admirable and, in the case of Obama being a sitting president, momentous, for him to have made an official statement, the President still needs to “walk the walk”, back up his words and sign the anti-discrimnation executive order.  

This morning on “Meet the Press“, Vice President Joe Biden had heads literally spinning when he gave his unequivocal endorsement for same sex marriage. Within minutes in the White House press room heads exploded and the walk back began.

BIDEN: The good news is that as more and more Americans come to understand what this is all about is a simple proposition. Who do you love? Who do you love and will you be loyal to the person you love? And that’s what people are finding out what all marriages at their root are about. Whether they are marriages of lesbians or gay men or heterosexuals. […]

GREGORY: You’re comfortable with same-sex marriage now?

BIDEN: Look, I am Vice President of the United States of America. The president sets the policy. I am absolutely comfortable with the fact that men marrying men, women marrying women and heterosexual men marrying women are entitled to the same exact rights. All the civil rights, all the civil liberties. And quite frankly I don’t see much of a distinction beyond that. […] I think Will & Grace probably did more to educate the American public than almost anything anybody has done so far. People fear that is different and now they’re beginning to understand.

President Obama must fire Federal Housing Finance Agency acting director Ed DeMarco because he “has flatly refused to do any kind of principal reduction for the millions of ‘underwater’ homeowners that are suffering, that are drowning in debt because of how the banks crashed the economy,” said Tracy Van Slyke, co-director of New Bottom Line. The coalition of faith-based and community organizations demand a “minimum of $300 billion in principal reduction.” Van Slyke claims New Bottom Line and other Occupy Wall Street-related efforts have “moved the administration far along from where they were. We have moved the dial.”

The Obama administration has repeatedly refused to spend moneys a set aside for distressed homeowners and communities. Why? Because banks have refused to cooperate with such programs, fearing that intervention in the housing market “would threaten to upset the bankers’ carefully calibrated market manipulations.” They would rather continue rigging the game. “The banks have been carefully dribbling out houses for sale, attempting to artificially stabilize prices with the goal of pumping up another bubble.”

The Obama administration’s failure to spend almost any of the $7.6 billion in TARP housing money set aside for the neediest regions of the country seems counterintuitive [..]

The Hardest Hit Fund was specifically targeted to homeowners in areas most seriously impacted by unemployment and falling home values – a formula tailor made for Black and Latino communities devastated by massive foreclosures and layoffs. [..]

The problem was, Obama’s people resisted putting the program into effect. [..]

The problem begins at the top. Obama has consistently protected bankers’ rights to deal with homeowners as they please.

AS reported in the Washington Post: Fannie Mae had seen benefits to lowering some home loans, documents indicate:

Officials at government-backed mortgage giant Fannie Mae concluded years ago that the company could “reduce its losses substantially” by lowering loan amounts for some troubled borrowers, according to internal documents cited Tuesday by the top Democrat on the House oversight committee.

The new insights into Fannie Mae’s analyses about the potential benefits of so-called principal reduction surfaced in a letter from Rep. Elijah E. Cummings (D-Md.) to Edward J. DeMarco, the acting director of the independent agency that oversees Fannie Mae and Freddie Mac.

Since being appointed head of the Federal Housing Finance Agency (FHFA) in 2009, DeMarco has refused to allow Fannie and Freddie to write down loan balances, in part because he worries that some homeowners would stop paying their mortgages to get relief, ultimately costing taxpayers more money. He has been steadfast in his disapproval in recent months despite growing pressure from Obama administration officials and House Democrats to allow principal reductions.

Those “internal documents” led to accusations that DeMarco, a Republican career public servant appointed by Obama to head the FHFA, withheld information from Congress about the findings:

“This just adds to the pile of evidence that calls into question how sincere DeMarco is about treating this issue seriously,” said Ian Kim, director of campaigns for Rebuild the Dream, a progressive advocacy group that has been urging a principal reduction program.

Supporters of principal reduction argue that it would reduce foreclosures by lowering the monthly payments for underwater homeowners and giving them hope they would one day have more equity in their homes.

Opponents counter that reducing the principal on mortgages owned or backed by Fannie and Freddie could increase their losses and encourage homeowners who are making payments to fall behind in order to lower their debt.

The new documents contradict DeMarco’s congressional testimony in November that analyses by Fannie and Freddie concluded that other forms of homeowner assistance were less costly to taxpayers, the lawmakers said. [..]

The failure to launch a principal reduction program “was not merely a missed opportunity, but a conscious choice that appears to have been based on ideology rather than Fannie Mae’s own data and analyses,” the lawmakers said.

It’s time for DeMarco to go and the Obama administration to stop protecting the bankers who won’t support him ever.

President Barack Obama has resumed drone attacks into Pakistan and sends one of is lackeys to defend it as legal, blithely dismissing civilian casualties:

NEW YORK – April 30 – President Obama’s top counter-terrorism adviser today publicly confirmed that the United States conducts targeted killings of suspected terrorists using drones.

In a speech this afternoon at the Woodrow Wilson Center in Washington, John Brennan insisted the targeted strikes are a “wise choice” and “legal” and within the boundaries of international law. However, ACLU Deputy Legal Director Jameel Jaffer said Brennan’s statement did not go far in explaining how the program passed constitutional muster.

“This is an important statement – first because it includes an unambiguous acknowledgement of the targeted killing program and second because it includes the administration’s clearest explanation thus far of the program’s purported legal basis.” Jaffer said.

“But Mr. Brennan supplies legal conclusions, not legal analysis. We continue to believe that the administration should release the Justice Department memos underlying the program – particularly the memo that authorizes the extrajudicial killing of American terrorism suspects. And the administration should release the evidence it relied on to conclude that an American citizen, Anwar al-Aulaqi, could be killed without charge, trial, or judicial process of any kind.”

Brennan maintained the Obama administration was committed to transparency when it came to deciding who would be subject to lethal drone strikes. But Hina Shamsi, director of the ACLU National Security Project, said the program is both unconstitutional and overly broad.

“We continue to believe, based on the information available, that the program itself is not just unlawful but dangerous. This statement makes clear that the administration is treating legal restrictions on the use of force as questions of preference. Moreover, it is dangerous to characterize the entire planet as a battlefield,” Shamsi said.

“It is dangerous to give the President the authority to order the extrajudicial killing of any person – including any American – he believes to be a terrorist. The administration insists that the program is closely supervised, but to propose that a secret deliberation that takes place entirely within the executive branch constitutes ‘due process’ is to strip the Fifth Amendment of its essential meaning.”

Representatives of Human Rights Watch and Amnesty International USA said they welcomed the unprecedented public acknowledgement of the drone campaign by John Brennan, assistant to the president for homeland security and counterterrorism.

But they said there are still serious questions about whether drone attacks on suspected millitants are legal under international law.

“Where there’s a war, for example in Afghanistan, [drone strikes] are a legitimate weapon of war,” said Tom Parker, a former British government security official who is now head of Amnesty International’s counter-terrorism program. “The problem comes when you make the unprecedented claim that you are in a world-wide conflict with a non-state actor.”

“We don’t believe that the justification [offered by Mr. Brennan] stands up under international humanitarian law,” he added.

Activists, lawyers, human rights advocates, civil liberties defenders and others came together for a major international summit on drone warfare and the issues created by drone use yesterday. The summit was co-organized by CODEPINK, the Center for Constitutional Rights and Reprieve. An exceptional lineup of speakers addressed participants detailing salient and significant aspects around the Obama administration’s expansion of the covert drone wars in countries like Pakistan, Somalia and Yemen. [..]

Scahill opens his speech by saying, “The real death panels that we have in this country were unleashed on our own citizens. Republicans like to talk about death panels having to do with health care. President Obama is the one that is operating secret death panels” that include United States citizens and often include non-US citizens. The vast majority of the victims of this policy around the world are not US citizens.

The “secret drone” program is the biggest absurdity in town. Every one knows the CIA is using drones and has requested an expansion of their use, the Bush and Obama administrations have admitted to using drones, Obama has even joked about it. We know that Obama has assassinated American citizens with it, without due process, but it’s a secret Really? How stupid does the Obama administration think we are?

Ten days ago, I wrote about a request made by CIA Director David Petraeus to expand the drone war in Yemen in accordance with the following, as expressed by the first paragraph of The Washington Post article reporting it [..]

At the time, I wrote that “it’s unclear whether Obama will approve Petraeus’ request for the use of ‘signature strikes’ in Yemen,” though that was true only in the most technical sense. It was virtually impossible to imagine that a request from David Petraeus, of all people, to Barack Obama, of all people, for authority to target even more people in Yemen for death, now without even knowing who they are, would be anything but quickly and eagerly approved. And that is exactly what has now happened, as the Post’s Greg Miller reports today:

   The United States has begun launching drone strikes against suspected al-Qaeda operatives in Yemen under new authority approved by President Obama that allows the CIA and the military to fire even when the identity of those who could be killed is not known, U.S. officials said. . . .

   The decision to give the CIA and the U.S. Joint Special Operations Command (JSOC) greater leeway is almost certain to escalate a drone campaign that has accelerated significantly this year, with at least nine strikes in under four months. The number is about equal to the sum of airstrikes all last year. . . .

   Congressional officials have expressed concern that using signature strikes would raise the likelihood of killing militants who are not involved in plots against the United States, angering Yemeni tribes and potentially creating a new crop of al-Qaeda recruits. . .

   Gregory Johnsen, a Yemen expert at Princeton University, has questioned . . . the wisdom of the expanded drone operations. . . . “I would argue that U.S. missile strike[s] are actually one of the major – not the only, but a major – factor in AQAP’s growing strength.”

Clive Stafford Smith, the director of Reprieve, a group representing the victims of drone strikes, joins from the Drone Summit in Washington, DC, an event set to investigate the expanding US drone program. The Up panelists key in on what this “expansion” means as the military continues to utilize drone strikes.

Michael Hastings, featured writer for Rolling Stone and a guest panelist on Up with Chris, wrote this chilling analysis of the history and current use of drones and “how killing by remote control has changed the way we fight“:

The use of drones is rapidly transforming the way we go to war. On the battlefield, a squad leader can receive real-time data from a drone that enables him to view the landscape for miles in every direction, dramatically expanding the capabilities of what would normally have been a small and isolated unit. “It’s democratized information on the battlefield,” says Daniel Goure, a national security expert who served in the Defense Department during both Bush administrations. “It’s like a reconnaissance version of Twitter.” Drones have also radically altered the CIA, turning a civilian intelligence-gathering agency into a full-fledged paramilitary operation – one that routinely racks up nearly as many scalps as any branch of the military.

But the implications of drones go far beyond a single combat unit or civilian agency. On a broader scale, the remote-control nature of unmanned missions enables politicians to wage war while claiming we’re not at war – as the United States is currently doing in Pakistan. What’s more, the Pentagon and the CIA can now launch military strikes or order assassinations without putting a single boot on the ground – and without worrying about a public backlash over U.S. soldiers coming home in body bags. The immediacy and secrecy of drones make it easier than ever for leaders to unleash America’s military might – and harder than ever to evaluate the consequences of such clandestine attacks.

“Drones have really become the counterterrorism weapon of choice for the Obama administration,” says Rosa Brooks, a Georgetown law professor who helped establish a new Pentagon office devoted to legal and humanitarian policy. “What I don’t think has happened enough is taking a big step back and asking, ‘Are we creating more terrorists than we’re killing? Are we fostering militarism and extremism in the very places we’re trying to attack it?’ A great deal about the drone strikes is still shrouded in secrecy. It’s very difficult to evaluate from the outside how serious of a threat the targeted people pose.”

85 days and counting since President Obama announced in his State of the Union speech the formation of the Residential Mortgage Backed Securities Working Group (RMBS) co-chaired by NY State Attorney General Eric Schneiderman and it is still a toothless entity that has so office space, phones and has yet to be staffed. The New york Daily News noticed, suggesting that Schneiderman should quit this fraud:

[..]calls to the Justice Department’s switchboard requesting to be connected with the working group produced the answer, “I really don’t know where to send you.” After being transferred to the attorney general’s office and asking for a phone number for the working group, the answer was, “I’m not aware of one.”

The promises of the President have led to little or no concrete action.

In fact, the new Residential Mortgage Backed Securities Working Group was the sixth such entity formed since the start of the financial crisis in 2009. The grand total of staff working for all of the previous five groups was one, according to a surprised Schneiderman. In Washington, where staffs grow like cherry blossoms, this is a remarkable occurrence.

We are led to conclude that Donovan was right. The settlement and working group – taken together – were a coup: a public relations coup for the White House and the banks. The media hailed the resolution for a few days and then turned their attention to other topics and controversies.

But for 12 million American homeowners, collectively $700 billion under water, this was just another in a long series of sham transactions.

Schneiderman, who has acted boldly and honorably, should distance himself from this cynical arrangement. He should resign and go back to working effectively with fellow attorneys general in Delaware, Massachusetts and Nevada.

They are much more likely to create the kind of culture of accountability in the financial community that will protect U.S. families from the next real estate scam.

According to a Reuter’s report, the office space has been located:

   The task force includes the Justice Department, the SEC, the FBI and the Department of Housing and Urban Development, among others. It is charged with investigating the pooling and sale of home loans that contributed to the financial crisis.

   While the group faced some skepticism, considering the crisis began nearly five years ago, there are signs it is serious about bringing cases.

   The co-chairs meet formally every week and talk almost every day to coordinate on “a range of investigations,” a Justice Department official said, on condition of anonymity.

   About 50 staff members are working on the effort, and the task force has identified separate office space in Washington and will move some personnel there, the official said.

   The Justice Department last month posted a one-year position of full-time coordinator for the working group who could help manage discovery and coordinate investigations, according to the job posting.

Yves Smith at naked capitalism agrees that Schneiderman has been had by the Obama administration:

It was pretty obvious Schneiderman had been had. Obama tellingly did not mention his name in the SOTU. Schneiderman was only a co-chairman of the effort and would still stay on in his day job as state AG, begging the question of how much time he would be able to spend on the task force. His co-chairman is Lanny Breuer from the missing-in-action Department of Justice. And most important, no one on the committee was head of an agency, again demonstrating that this wasn’t a top Administration priority.

However, she disagrees with the Daily News assessment of Schniederman acting “boldly and honorably” and that he can go back to working with the other attorneys general:

Schneiderman’s actions were neither bold nor honorable. Not surprisingly, his effort at a star turn in the national media has not led to favorable poll results for him in New York. And the Daily News offers a fantasy as an alternative. There is no “going back.” The attorneys general gave up their best legal theories, and with it, their ability to protect the integrity of title, for grossly inadequate compensation and a photo opportunity.

It would be better if we were proven wrong, but Schneiderman entered into an obvious Faustian pact. He’s not getting his soul or his reputation back.

A recent report showed that mortgage foreclosure scams have spiked 60 percent in 2012, while the nation’s biggest banks continue to sit upon a slew of fraudulent mortgage documents. A recent investigation of foreclosures in San Francisco found that nearly all of them had legal problems or suspicious documents, prompting the city council to suggest a foreclosure moratorium.
