What is it that the Democrats do not understand about Negotiating 101? Peter Daou states it succinctly how the Republicans have dominated the debate and why the Democrats fail so miserably

There is a simple formula for rightwing dominance of our national debate, even when Democrats are in charge: move the conversation as extreme right as possible, then compromise toward the far right. It’s negotiation 101.

The Democrats just don’t get it.

House Minority Leader, John Boehner will call for the resignations of Treasury Secretary Tim Geithner and White House Economic Advisor, Larry Summers. While I can’t disagree with him, since I thought the appointment of these two was wrong from the start, Boehner is doing it for all the wrong reasons because everything that Geithner and Summers have done so far is almost exactly what the Republicans would have done were they in power, continuing the banking and financial industry bail outs, watering down Financial regulation and cutting the stimulus bill to making it ineffective in creating jobs. It’s almost like these two are “moles” for the Republicans but Boehner is making them the starting point of the conversation. While the media mentions that Boehner supports the renewal of the Bush tax cuts to “to sparking job growth”, they failed to mention that those cuts have been in effect for the last 10 years and have failed to stimulate the economy or create jobs. The Democrats need to hammer that home, instead they waffle

It is no wonder, as Daou continues to point out,

it matters not one iota if Obama is a progressive at heart. What matters is that Democrats run away from the left like it’s the plague while Republican run to the right like it’s nirvana. The net effect is that the media end up reporting far right positions as though they were mainstream and reporting liberal positions as thought they were heinous aberrations. And you wonder why America is veering off the rails?

The left can’t push that pesky Overton Window to the middle so long as they continue to muddle the negotiations and allow, as David Waldman called Boehner, a “Stopped Clockwork Orange”, to dominate the bargaining table.

“American Muslims Were Not Behind the Terrorist Plot”

I am really getting disgusted with the cowardice and bigotry that is being demonstrated by our politicians and news media. This exchange on CNN between news anchor, Don Lemon and Eboo Patel, Executive Director of the Interfaith Youth Corps revealed the media bias against the American Muslim community.

   Lemon: Don’t you think it’s a bit different considering what happened on 9/11? And the people have said there’s a need for it in Lower Manhattan, so that’s why it’s being built there. What about 10, 20 blocks . . . Midtown Manhattan, considering the circumstances behind this? That’s not understandable?

   Patel: In America, we don’t tell people based on their race or religion or ethnicity that they are free in this place, but not in that place —

   Lemon: [interrupting] I understand that, but there’s always context, Mr. Patel . . . this is an extraordinary circumstance. You understand that this is very heated. Many people lost their loved ones on 9/11 —

   Patel: Including Muslim Americans who lost their loved ones. . . .

   Lemon: Consider the context here. That’s what I’m talking about.

   Patel: I have to tell you that this seems a little like telling black people 50 years ago: you can sit anywhere on the bus you like – just not in the front.

   Lemon: I think that’s apples and oranges – I don’t think that black people were behind a Terrorist plot to kill people and drive planes into a building. That’s a completely different circumstance.

   Patel: And American Muslims were not behind the terrorist plot either.

Protecting Women’s Right to Choose Treatment

In March of 2009, a working mother with two toddlers, Samantha Burton, was 25 weeks pregnant and showing signs of miscarrying. When she told her doctor that it would be impossible for her to comply with his order of complete best rest for as long as 15 weeks and that she would seek a second opinion. When she tried to leave the Tallahassee where she had gone voluntarily, the hospital went to court, obtaining a court oder forcing her to remain in the hospital and submit to anything to preserve the life and health of unborn child.

The Florida ACLU intervened on her behalf to strike down the court order that rendered her powerless to make her own medical decisions. The a three judge panel rules that the order set a dangerous precedent and over turned the order but not before MS. Burton was forced to undergo a C-Section and gave birth to a still born. Ms. Burton and the ACLU decided to pursue the case to protect other women from the abuse of a woman’s right to make medical decisions about her health care.

Yesterday, Florida District Court of Appeal ruled that the rights of a pregnant woman were violated when she was forced to remain hospitalized against her will after disagreeing with a hospital’s recommended treatment.

So if you’re a pregnant woman, you now have the radical right to choose your own doctor and have a say in your treatmetn, even if a judge thinks he knows better. Radical!!

Kind of crazy, all this rights-upholding going on. It might just lead you to believe we were in the United States or something.

Obama White House Enshrining Bush-Era Policies

The ACLU has issued a report on national security, Establishing a New Normal. It is an 18 month review that examines Pres. Obama’s record on national security and civil liberties. The report finds that while the President has some steps to curb torture, the CIA secret prisons and the release of the Bush administrations torture memos, according to Anthony D. Romero, Executive Director of the ACLU:

“President Obama began his presidency with a bang, signing executive orders that placed the power of the presidency behind the restoration of the rule of law and gave meaning to the president’s stated view that America must lead with its values. “Unfortunately, since that time, the administration has displayed a decidedly mixed record resulting, on a range of issues, in the very real danger that the Obama administration will institutionalize some of the most troublesome policies of the previous administration – in essence, creating a troubling ‘new normal.’ We strongly urge the president to shift course and renew his commitment to the fundamental values that are the very foundation of our nation’s strength and security.”

While the Press Secretary, Robert Gibbs, was attacking the Left and Liberals for comparing President Obama’s polices to George W. Bush’s, the reality is we and the “professional left” aren’t wrong. This isn’t going to go away just because the Obama loyalists want us to shut up and vote.

Judge Will Lift Stay on Same Sex Marriage on August 18: Up Date x 2 with Video

Judge Vaughn Walker rules today that the stay he issued on his ruling that Prop 8 banning of gay marriage was unconstitutional, will be permanently lifted on August 18. At that time, all districts will cease to enforce Prop 8 and allow all to register to marry.

There was also a question of the standing of the proponents to appeal this stay and the ruling since this is a state law and the state of California has decided not to pursue an appeal.

The Travesty of Omar Khadr

Omar Khadr’s military judge just ruled that ALL of his confessions from Afghanistan to #Guantanamo will go to trial. None suppressed.

If you haven’t heard of Omar Kadr, he is a Canadian citizen and the youngest prisoner held in the Guantanamo Bay detention camp by the United States, has been frequently referred to as a child soldier and the only Western citizen remaining in Guantanamo. The Canadian Government has refused to seek extradition or repatriation despite the urgings of Amnesty International, UNICEF, the Canadian Bar Association and other prominent organizations. In 2009, it was revealed that the Canadian government had spent over $1.3 million to ensure Khadr remained in Guantanamo. Canada failed Kadr by refusing to admit that he was a juvenile and his repeated claims that he was abused. n April 2009, the Federal Court of Canada ruled that the Charter of Rights and Freedoms made it obligatory for the government to immediately demand Khadr’s return. After a hearing before the Court of Appeals produced the same result, the government announced they would argue their case before the Supreme Court of Canada. In January 2010, the Supreme Court ruled that Khadr’s constitutional rights had clearly been violated, but it stopped short of ordering the government to seek his return to Canada.

Khadr was the only person charged under the 2006 Military Commissions Act who did not boycott the Guantanamo proceedings. Canadian authorities also determined that Khadr had little knowledge of his father’s alleged activities, since “he was out playing or simply not interested”.

side from the obvious moral issues with trying someone for an alleged crime committed on a battlefield when they weren’t old enough to drive, vote, drink alcohol, or consent to sex in the United States, there’s the additional weirdness of trying the killing as a “war crime.” Human-rights groups say  no one has ever before been tried for a war crime merely for the act of killing the other side’s soldiers in combat, but the government maintains that Khadr is an “unprivileged enemy belligerent,” so the charge is appropriate.

It’s a really weird argument. By trying Khadr in a military commission, they’re essentially making him a soldier, but they’re saying the reason his alleged killing of Speer was a war crime is because he’s not a soldier. If Khadr killed Speer, that’s certainly a crime. But a war crime?

Gibbs Inserts Foot Deeper into His Mouth

Well, if we on the Left had expected a contrite Robert Gibbs today, I hope everyone wasn’t too disappointed because today MR. Gibbs stood by his criticism of us and said he expects us to get out and vote in the Fall.

Speaking publicly for the first time since he disparaged the “professional left,” White House Press Secretary Robert Gibbs said he stands by his comments, has no plans to resign and that he fully expects progressive voters to go to the polls in 2010.

“I don’t plan on leaving and there is no truth to the rumor that I’ve added an inflatable exit to my office,” the press secretary said during Wednesday’s briefing, referencing the recent incident in which a Jet Blue flight attendant bolted his plane in frustration.

Taking the podium after a day off to tend to a sore throat, Gibbs said he has not reached out to any Democrats to discuss his remarks, in which he chastised liberals for wanting to “eliminate the Pentagon” and pursue Canadian-style health care reform. Nor, he added, has he talked to the president about the matter.

Does he stand by the comments? “Yes,” he replied.

Dear Mr. Gibbs

Do you really think that with this kind of rhetoric and then the non-apology walk back, that you are going to win the hearts and votes of the Left, the Independents and Moderate Republicans?

Come on, Bob. Do you even recognize the man in the Oval Office as being the same man from the campaign trail? Granted many of us knew damned well he wasn’t a progressive or even a so-called centrist for that matter. He was already reneging on his promises when the instead of filibustering the FISA renewal bill, he voted for it.

For someone who was so critical of Bush’s wars and the Presidential powers that Bush had assumed, he certainly has embraced them now and then some. Bush is probably wishing he could have gotten away with what Obama is doing that is being ignored by his proponents. Wow, targeted assassinations of American citizens, suspending habeus corpis on whim and prosecuting minors for war crimes. Cool. Now he wants unfettered access to private e-mail. Why not just repeal the 4th Amendment.

And how about that Cat Food Commission? Oops, sorry Obama’s supporters don’t like that term for the Deficit Commission that is proposing cutting Social Security and Medicare benefits. Brilliant. Bush never would have gotten away with that.

And wow, not just one woman on the Supreme Court but two. One who has a history of rulings in favor of corporations and the other with no bench experience but a supporter of the unitary executive that was greatly expanded under Bush and explicitly adopted and expanded by Obama.

Yes, Mr. Gibbs, we on the Left are not happy with the corporatist, neoliberal agenda that is coming from your boss. You don’t like the criticism than maybe you’d best listen to what we are saying instead of whining about it. The hallmark of a democratic society is criticism. We are still living in a democratic society so far. Or are we?
